Terms and Conditions

This is a translation for information purposes. In case of any discrepancy, the Czech version prevails.

1. Basic provisions

These terms and conditions govern the rights and obligations between the operator of the driving school and the student in the provision of tuition and training to obtain or extend a driving licence and in the provision of related services.

(hereinafter the "driving school").

These terms and conditions apply to both of the branches listed above.

2. Enrolment in tuition and training

  • The student is enrolled in tuition and training after meeting the conditions laid down by law and by agreement with the driving school.
  • The student is obliged to provide the driving school with true and complete information and to submit the required documents.
  • The student is responsible for the accuracy of the information provided to the driving school.
  • Before tuition and training begin, the driving school is entitled to require that all legal conditions for enrolment in tuition and training are met.

3. Price and payment terms

  • The prices of individual courses, training and other services are not part of these terms and conditions.
  • Current prices are listed in the separate price list of STRIX Driving School.
  • The price may differ depending on the type of course, driving licence category, teaching method, transmission, scope of service or language of instruction.
  • The specific price of a service is determined for the student according to the current offer and the price list valid at the time of ordering or concluding the relevant agreement.
  • The driving school may require payment of the price before the course begins, or allow another method of payment based on an individual agreement.
  • Unless agreed otherwise, the student is obliged to pay the price by the agreed date.

4. Tuition and training

  • Tuition and training take place to the extent laid down by the relevant legislation for the given driving licence category.
  • Dates of driving lessons and tuition are arranged individually, taking into account the capacity of the driving school, the instructor and the vehicle.
  • The driving school may change an agreed date for organisational, technical or operational reasons. In such a case it will offer the student an alternative date.
  • The student is obliged to arrive for the agreed lesson on time and ready for tuition or training.
  • The student is obliged to follow the instructions of the driving instructor and to observe safety and traffic rules.

5. Cancellation or change of an agreed lesson

  • If the student cannot attend an agreed driving lesson or another individually agreed part of tuition or training, they are obliged to inform the driving school without undue delay.
  • Repeated late cancellations, failure to attend or other serious breaches of the agreed rules may be a reason for resolving further steps individually.
  • Any specific compensation or fee for a lesson that did not take place is governed by the current price list, if such a fee is stated in the price list.

6. Exams

  • Once the legal conditions are met, the driving school will register the student for the exam in the manner and to the extent laid down by law.
  • The date and place of the exam are determined by the competent public authority.
  • Fees related to the exam and its retakes are paid according to the current price list of the driving school and according to any fees laid down by law.
  • The student is obliged to attend the exam on the set date and to meet all the conditions necessary for taking it.

7. Transfer from another driving school

  • By agreement, the driving school may accept a student who started tuition or training at another driving school.
  • The transfer is subject to meeting legal and administrative conditions.
  • A fee of 5 000 Kč is charged for the administrative processing of a transfer from or to another driving school, unless agreed otherwise with the student.
  • The transfer does not affect any claims for payment for services already provided or costs incurred.

8. Early termination of the course by the student

  • The student may request early termination of their course.
  • If the course is terminated early at the student's decision, a fee of 7 000 Kč is charged for the administrative and organisational tasks associated with early termination of the course, processing of the student's records and closing of their training.
  • This fee is not a contractual penalty for breach of the student's obligations, but a fee for the tasks and administration associated with early termination of the course.
  • The final financial settlement will take into account in particular:
  • the price of services already provided,
  • amounts paid,
  • the early termination fee,
  • any other duly incurred and payable fees.
  • Any overpayment will be refunded to the student by the driving school after the final settlement. Any underpayment must be paid by the student.
  • The provisions of this article shall not apply to the extent that their application would conflict with mandatory provisions of law, in particular the statutory rights of consumers.
  • Early termination does not affect the driving school's claims for payment for services duly provided up to the moment of termination.

9. Other fees

In addition to the price of a specific course or service, the following fees may be charged:

  • Transfer from or to another driving school: 5 000 Kč
  • Early termination of the course: 7 000 Kč
  • First regular exam – authority fee: 700 Kč
  • Retake test: 500 Kč
  • Retake practical driving test: 1 000 Kč

The amount of other fees may be changed by updating the price list. For a specific service, the price list valid at the time it was ordered or when the relevant obligation arose is decisive.

10. Obligations of the student

The student is in particular obliged to:

  • provide the driving school with true information,
  • pay the agreed prices and fees properly and on time,
  • attend tuition and training on the agreed dates,
  • follow the instructions of the driving instructor,
  • observe safety rules,
  • not take part in tuition or training under the influence of alcohol, addictive or other substances that may affect the ability to drive safely,
  • report without delay any changes to information important for tuition, training or the exam.

11. Obligations of the driving school

The driving school undertakes to provide the agreed tuition and training in accordance with the relevant legislation and to the extent corresponding to the driving school's authorisation.

The driving school keeps the necessary documentation and student records and fulfils its legal obligations towards the competent public authorities.

12. Personal data

  • The driving school processes students' personal data in accordance with applicable legislation, in particular the GDPR.
  • Detailed information on the processing of personal data is provided in the separate document Personal Data Processing Policy of STRIX Driving School, published on the driving school's website.
  • The student is obliged to provide the information necessary for concluding and performing the contractual relationship and for fulfilling the driving school's legal obligations.

13. Complaints

  • The student may submit comments, claims or complaints to the driving school using the contact details given in these terms and conditions.
  • The driving school will deal with every properly submitted complaint and settle it in accordance with the relevant legislation.
  • This does not affect consumer rights arising from the law.

14. Consumers and distance contracts

  • If the student is a consumer and the contract is concluded by means of distance communication, special legal provisions on consumer protection may apply to the contractual relationship.
  • The consumer's right to withdraw from the contract within the period laid down by law is not affected by these terms and conditions.
  • If the consumer expressly requests that the provision of the service begin before the statutory withdrawal period expires, the legal consequences laid down by law may apply.

15. Final provisions

  • These terms and conditions apply to the STRIX Driving School branches in Velké Přílepy and Slaný.
  • The current version of the terms and conditions is published on the STRIX Driving School website.
  • The driving school is entitled to reasonably amend or supplement the terms and conditions. The contractual relationship is governed by the version in effect at the time it arose, unless the law or an agreement provides otherwise.
  • If any provision of these terms and conditions becomes invalid or ineffective, this does not affect the validity of the other provisions.
  • Rights and obligations not governed by these terms and conditions are governed by the laws of the Czech Republic.
